All services provided by GoCodeIT Inc d/b/a Xenyth Cloud may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any Canadian federal, Province or city law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless GoCodeIT Inc from any claims resulting from the use of service which damages the subscriber or any other party.
GoCodeIT Inc will not be responsible for any damages your business may suffer. GoCodeIT Inc makes no warranties of any kind, expressed or implied for service we provide. GoCodeIT Inc disclaims any warranty of merchantability or fitness for a particular purpose. This includes loss of data resulting in delays, no deliveries, wrong delivery, and any and all service interruptions caused by GoCodeIT Inc and its employees. GoCodeIT Inc reserves the right to change its policies at any time without prior notification.

2. Payment Policy
Your account will not be activated until we receive your first months payment. Users will receive invoices that are sent via email approximately three days before they are due. Invoices are to be paid on or by the date on the invoice. Failure to comply will result in your account being terminated. If you then wish to re-register for the account, all regular sign-up rules and prices will apply. If at any time your account becomes past due or inactive for any reason, we reserve the right to change your rate to match the current prices. We reserve the right to deny any order. Credit card order: If your order is processed you may be asked to send us a copy of your credit card for security reasons before your account is activated. All orders are subject to being denied. All credit card and PayPal payments are automatically billed every month.
2.1. VPS Payment Policy
Payments are due every month on the date of registration. Payments are considered late after 1 day following the due date. If the account is not paid on the due date the account may be terminated. GoCodeIT Inc will terminate the customer’s service if the invoice is 3 days overdue. If the server is suspended, payments are subject to a $15.00 reconnection fee.
2.2. Late Fees
Payments are due every month on the date of registration. They are considered late after 1 day following the due date. If the account is not paid 2 days following the due date a late fee of 15% will be added to the invoice. This fee must be paid prior to activation of the late account.
3. Services Changes
GoCodeIT Inc reserves the right to change prices, policies, and configuration of any and all accounts when deemed necessary. Any violations of these policies represent a breach of your contract with us, and your account will be removed from our system without warning.
4. Regional Laws
GoCodeIT Inc expects that its customers will abide by all of our rules and all applicable laws. A subscriber’s failure to comply with those laws will violate GoCodeIT Inc policy. Finally, GoCodeIT Inc wishes to emphasize that in signing the service agreement, subscribers indemnify GoCodeIT Inc for any violation of the service agreement, law, or GoCodeIT Inc policy, that results in loss to GoCodeIT Inc or the bringing of any claim against GoCodeIT Inc by any third-party. This means that if GoCodeIT Inc is sued because of a subscriber’s or customer of a subscriber’s activity, the subscriber will pay any damages awarded against GoCodeIT Inc, plus costs and reasonable attorneys' fees.
5. Abuse of Services
5.1 Prohibited Activities
Services that promote any illegal activity or present content that may be damaging to GoCodeIT Inc infrastructure, servers, or any other server on the Internet are Strictly Prohibited. Links or References to such materials are also prohibited. Links or References to tutorials related to such material are also prohibited.
Any attempt to undermine or cause harm to a server or customer of GoCodeIT Inc is strictly prohibited. As our customer you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be cancelled without chance of refund. Server abuse includes but is not limited to the following:
- CPU/Ram/Disk/Resource intensive Programs
- Denial of Service Attacks (Distributed or otherwise)
- Hacking/cracking of any kind (This includes exploits)
- Account trading
- Spamming, Including but not limited to Mail Spam, Web Spam, Ping Spam, etc.
- Transmission, Storage, or Distribution of any Adult Content, Sexually Explicit Services, Child Pornography, Hentai, or any similar material is strictly prohibited.
- Transmission, storage, or distribution of any information, data, or material in violation of any law or regulation is prohibited. This included but not limited to: copyrighted material, trademarks, or any other illegal content. Examples: Movies, MP3s, Pirated Software, Hacker Programs, or Warez Sites.
- Sale of controlled substance or online pharmacies.
- Autosurf sites, investment sites, escrow, HYIP, bank debenture programs, gambling, or lottery sites.
- Brute force programs, IP/Port scanners, mail bombers, and spam scripts.
- Bitcoin or AltCoin mining.
- Any part of the TOR architecture (Exit nodes, Entry nodes, Relays).
GoCodeIT Inc will be the sole arbiter as to what constitutes a violation of any given server, and reserves the right to terminate the account without notification.
5.2 Acceptable Content
GoCodeIT Inc agrees with freedom of speech. However GoCodeIT Inc does not allow websites with the following content: Racism of any kind including but not limited to color, religion, creed, or any other beliefs. Other content that is prohibited are threats, hate websites, terrorist websites, violent websites, malicious content, adult content, and any illegal activities.
5.3 Mail Spam
GoCodeIT provides access to SMTP at our sole discretion, and may deny access to SMTP to any user for any reason. SMTP is not guaranteed on our platform and any refund request based on SMTP access will be denied. We have a zero tolerance SMTP abuse and reliability policy.
GoCodeIT Inc has a zero tolerance spam policy. We do not allow unsolicited e-mail, bulk emailing, and spam. Any user found doing such activity will have their account terminated. Websites that are advertised via spam may not be hosted on our servers.
Subscribing email addresses to any mailing list without express permission of the email address owner is prohibited. All mailing lists run on our servers must be Closed-loop (Confirmed Opt-in).
We have the sole right to remove your access to SMTP at any point, at your cost, for any reason. We are not responsible for any damage incurred in this process, nor do we issue refunds for those who have lost (or were denied) access to SMTP.
Users may be charged a fee for blacklist removal of $350.00 or more.
5.4 Server Resource Abuse
Any VPS that uses a high amount of system resources such as but not limited to CPU time, memory usage, and network resources will be notified in email of such activity to reduce their account to an acceptable level. The customer must then reduce their account to an acceptable level. GoCodeIT Inc shall be the sole arbiter of what is considered to be high server usage.
Any dedicated server or VPS account that exceeds their monthly bandwidth allotment will be subject to a bandwidth overage charge disclosed at the time of their original order. This charge is due within 7 days of the date the overage is invoiced.
5.5 IP Resource Abuse
Any IP address or subnet registered through us, allocated by us, or leased by us, whether part of another service or standalone, is subject to the following:
- Any Abuse reports received will be relayed to you (the customer) and must be resolved within 48 hours, at risk of termination without refund.
- Your IP Space must abide by our list of prohibited activities, even if you are using them elsewhere in your own infrastructure.
- On return or termination of your IP space, you will be charged USD$20 per individual IP address on zen.spamhaus.org
- Customer IP ranges with allocations larger than /29 V4 and /52 V6 must provide detailed usage as according to ARIN usage guidelines.
- IP address ranges not part of a bundled service are not eligible for refund, and may only be cancelled at the end of their term. IP address ranges part of a bundled service may be eligible if all other services in that bundle are eligible.
- All ARIN IP allocations must abide by ARIN downstream customer guidelines (ARIN NRPM 4.2.3).
6. Early Termination/Cancellation
GoCodeIT Inc reserves the right to cancel a customer’s service at any time. If cancellation is caused by customer’s violation of these policies, then no refund is due. Customers may cancel service at any time, but no refund is due. GoCodeIT Inc does not offer partial refunds on any services under any circumstances.
If you wish to cancel your services, you must notify us at least five (5) business days prior to your renewal date. If your notice of cancellation is not received within this time frame, you will be liable for payment of the upcoming month and hereby agree to complete payment as invoiced accordingly. You may cancel by sending a support ticket or by using the cancellation form within your client area.
If you cancel your account and your payments still continue to recur for any reason such as:
- by fault of GoCodeIT Inc staff
- by fault of the payment processor
- by fault of any other payment collection company
We are to be held free of liability for any overdraft fees that are issued by your financial institution.
GoCodeIT Inc does not offer any refunds on any services. You may cancel your subscription at any time, however no refunds will be issued. Licenses and add-ons are non-refundable.
7. Refusal of Service
We reserve the right to refuse, cancel or suspend service, at our sole discretion.
All sub-networks, distributive hosting sites, dedicated servers, resellers, customers of customers, and colocation customers of GoCodeIT Inc, must adhere to the above policies.
8. Collected Data
8.1 Automatically Logged Information
We use your IP address to help diagnose problems with our server and to administer our services. We use this information for no other reason.
8.2 Input Forms
Our site uses many input forms for customers to provide services. We collect sensitive information which is used only for our purpose, no third party receives any type of personal information from us.
Contact information from order forms is used to get in touch with the customer.
Billing information is collected to bill the user for services.
Unique identifiers are collected from visitors to verify their identity.
Demographic and profile data is collected to tailor our visitor’s experience at our site showing them content that we think they might be interested in, and displaying the content according to their preferences.
8.3 Browser and Computer Specific Fingerprints
Our websites use Cookies and Local Storage, in order to recognize your browser and capture and remember certain information. One of the many uses of Cookies and LocalStorage are to allow logging in to the website. We also use cookies to compile aggregate data about site traffic and site interactions in order to offer better experiences and services in the future. We may use Trusted third-party services that track this information on our behalf.
We use cookies, local storage, and javascript, in order to offer many parts of our dashboard and landing web sites, you are free to disable these features within your browser, however, many features may not function as expected.
9. Security
We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Website is at your own risk. You should only access this Website from a Secure Environment.
9.1 Billing Details
We do not interact with, process, or store your Card information to any level. All billing interactions are completed through our Payment Processors. Specifically, STRIPE, and PayPal. We only store data required to work with these Payment Processors, we do not store any data capable of directly charging your bank.

9.2 User Services
All users are solely responsible for their server security as each server will be given a public IP. While we have our firewalls in place, we strongly encourage all clients to secure their servers, change passwords, and never share their login information.
10. Third Parties
We send minimal data to third party companies, in order to improve our services and user experience. As well as to protect ourselves from potential fraud.
WE DO NOT SELL YOUR DATA TO ANYONE.
Below is a list of potential services we may send data to, as well as the scope of data we send. This is not an exhaustive list, and may change at any point.
10.1. Analytics and Advertisers
We utilise Google Analytics in order to track overall aggregate usage and analytics for our website. This allows us to improve user experience and view an over-all image of shortcomings in our websites. We do not send Google Analytics any personally identifiable information (PII). We utilise Sentry in order to improve user experience by reporting any errors that a user runs into while using our website, we DO NOT send any PII to Sentry.
10.2 Fraud and Abuse Prevention
We utilise FraudLabs in order to gauge customer fraud rates, to ensure we provide the best service and reduce downtime due to abuse or fraud. We do our best to limit the amount of PII we send to FraudLabs, but due to the nature of their services with us the data we provide is still sensitive in nature. When you sign up with us, we send a one-way hash of your E-mail address, your IP (Internet Protocol) address, and your Postal Code and Country. We believe that this maintains a safe level of anonymity for our users while still allowing us to continue monitoring and preventing bad actors from using our platform. It is important to note that we do NOT send any PII to FraudLabs, we send them a one-way encrypted message that they cannot easily reverse.
10.3 Payment Processors
We utilise PayPal as a payment processor to handle PayPal related transactions. We do not provide PayPal with any sort of PII. When you add PayPal to your account, we create a billing agreement, and use that to bill you.
We utilise Stripe as a payment processor to handle our non-PayPal transactions. Stripe directly handles your payment details and provides us with a secure access token to bill with. We do not request PII from Stripe. We provide Stripe with your E-mail address, IP Address, Postal Code, and Country. In order to allow us to match payments to users and to ensure minimal fraud.
